NON-DISCRIMINATION-POLICY

Bloom Buddy Limited is committed to providing telemedicine or teletherapy services free from discrimination and harassment. Bloom Buddy Limited does not encourage or tolerate discrimination or harassment on the ground of disability, race, ethnicity, religion, color, sex, age, national origin, sexual orientation, gender identity or expression, ancestry, pregnancy, or any other basis prohibited by law. Your use of our Platform and Services is also governed by the User Terms of Use or the Professional Terms and Conditions.

1. SCOPE

This policy applies to all Bloom Buddy employees, Professionals providing services on the Platform, and Users receiving services on the Platform (“You”).

2. DEFINITIONS

Any undefined capitalized terms used within this policy will have the same meaning as they do in the Terms.

a. Discrimination

In using our Platform, it is considered discrimination to base any decision on the provision of Services or receipt of such Services on disability, race, ethnicity, religion, color, sex, age, national origin, sexual orientation, gender identity or expression, ancestry, pregnancy, or any other characteristic protected by law;

b. Harassment

Harassment consists of unwelcome verbal or visual or written conduct that is based on another person’s disability, race, ethnicity, religion, color, sex, age, national origin, sexual orientation, gender identity or expression, ancestry, pregnancy, or any other characteristic protected by law, which may offend or humiliate the individual it is directed to. Harassment includes actions such as the use of epithets, slurs, negative stereotyping, jokes, or threatening, intimidating or hostile acts that relate to disability, sex, race, ethnicity, age, or other protected categories. Harassment also may include written or graphic material showing hostility toward an individual or group based on protected characteristics, whether that material is sent by email, or displayed on computer screens or other devices.

c. Sexual Harassment

Sexual harassment is any unwanted and unwelcomed behavior of a sexual nature. It can involve conduct by a person of either gender toward a person of the same or opposite gender.

3. LODGING A COMPLAINT

While Bloom Buddy is not responsible for issues between Users and Professionals, We take issues of harassment and discrimination very seriously and will take all reasonable measures to ensure that the Ecosystem remains a safe environment for all Users. We encourage you to come forward with a complaint on any actual or perceived cases of harassment or discrimination at the earliest possible time.

If you believe that you have been a target of discrimination or harassment or inappropriate behaviour whilst using our Platform, please report the incident in writing via email to support@thebloombuddy.com designated with entertaining such complaints and email of officer]. Bloom Buddy shall within 3 business days of receiving your complaint discontinue all communication/points of contact between the complainant and the subject of the complaint. If the complainant is a User, we will as soon as possible re-assign the User to an alternative Professional of their choice to minimize disruption of Service continuity.

If necessary, Bloom Buddy shall investigate the complaint to establish a violation of any of Our Terms. If a violation is found, Bloom Buddy shall take necessary action to address the incident and to restore safety and mutual respect on the Ecosystem, which may include the termination of a User or Professional’s account.

Where the Incidence constitutes a criminal act or a violation of the personal rights of a complainant and such complainant wishes to prosecute the subject of the complaint; Bloom Buddy shall provide the necessary support to the extent permitted under our Terms (including our Privacy Policy or Applicable Law) to enable the such complainant to pursue further legal action against a Professional or User (as the case may be).

Bloom Buddy assures you that the investigation of a complaint made against anyone in the Ecosystem, shall be transparent, handled promptly, confidentially, and impartially, and where discrimination or harassment is established, appropriate sanctions will be enforced. Be assured that when you lodge a complaint on discrimination or harassment, your complaint is kept confidential to the extent required by applicable law and will only be assessed by Bloom Buddy employees authorised to resolve such conflicts.
